Lakewood Tool Box User Agreement, Waiver, & Indemnification

1. Only Tool Box Members may borrow tools from the Lakewood Tool Box. Eligibility for membership is limited. Membership is open to all Lakewood residents, tenants and landlords. Once a year, all members must pay dues in accordance with the current Membership Schedule* and update their contact info. Current Membership dues are $30.00 per Lakewood Resident/Tenant and $75.00 per Lakewood Landlord. *See our website or call us for exact details, as they are subject to change.

1. The benefits of membership include:

1. Ability to borrow from approximately 60 rentable tools, ranging from standard hand tools to equipment for larger projects. Tools are rented on a first come, first served basis.

2. Ability to borrow expensive, high-maintenance tools at an affordable price.

1. All Members must show a Photo ID with a current address (or a valid Photo ID with two utility bills which demonstrate a current address) when borrowing a tool.

2. No contractors. The Lakewood Tool Box is a program for members to maintain and repair their living space, or properties they own. Tools are for Members only and are to be used at the address on file for their home, rental units, or nonprofit project locations only. Tools are not to be used for jobs.

3. Members must obtain their own consumables – tools are not loaned with any consumable parts – power saw blades, sandpaper, vacuum filters, grinding wheels, etc.

4. All tools are loaned for 7 days. If it was checked out on a Tuesday, it’s due back the following Tuesday. Failure to return tools by your due date will result in late fees, and a stop will be placed on your account (nothing else can be borrowed). After 30 days, unreturned tools will be considered stolen property and charges may be filed.

5. Tools must be returned to designated Lakewood Tool Box staff during our open hours. Tools cannot be dropped off during closed hours.

6. Tools must be returned clean and in the same condition as when checked out, or you will be subject to a $15.00 Deposit/Cleaning fee.

8. Tools returned past their due date will accrue daily late fees. Exact cost of fees varies per tool, from $15 per day up to 2 times the weekly rental fee.

9. Tool Library Members are responsible for lost, stolen, broken, and damaged tools – reasonable wear and tear expected. If stolen: notify the police and tell Lakewood Tool Box staff. If lost, stolen, broken, damaged, etc., Lakewood Tool Box reserves the right to keep tool deposits and assess additional fees for replacement or repair.

10. If a Member owes the Tool Box money – late fees, repairs, membership dues, etc – they cannot borrow any tools until all debt has been paid to the Tool Box.

11. The Tool Box Member is liable for any property damage caused by the use of library tools, including any damage caused by loading and unloading tools from Tool Box Member’s vehicle.

12. The Lakewood Tool Box reserves the right to limit the number of tools borrowed, refuse the loan of any tool or refuse Membership. Membership may be revoked at any time.

I further acknowledge and declare that I am qualified, in good health, and in proper physical condition to participate in such activity and to use the facilities, tools, and equipment provided.

I, _______________________________ (print name), understand the nature of the activity, the nature of all risks associated with the activity described above, the nature and proper use of any tools and equipment available to me, and I understand all rules pertaining to the activity and the use of facilities, tools, and equipment.

I, _______________________________ (print name), do hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, waive any and all claims against the Lakewood Tool Box and Lakewood Alive, Inc. for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from the Lakewood Tool Box. I understand that the use of tools and equipment, by their very nature, carry with them certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I understand that I am solely responsible for independently inspecting the tools and equipment and determining that such items are in good working condition prior to use.

I, _______________________________ (print name), hereby for myself, on behalf of my successors and assigns, in consideration of being permitted to borrow tools, agree to release and indemnify and hold harmless the Lakewood Tool Box and Lakewood Alive, Inc., its officers, agents, volunteers, and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arise or may arise or be occasioned in any way from the use or possession of tools I am borrowing from the Lakewood Tool Box.
